Return and refund
Article 1 – Legal Basis and Scope
This Returns and Refund Policy (hereinafter: “the Policy”) defines the conditions under which purchases via the official Emma & Rose Manhattan webshop may be returned, canceled, or refunded. The Policy is established in accordance with:

Dutch Civil Code;

Consumer Protection (Fair Trading) Act 2019 (Singapore), insofar as it is mandatory;
-
Generally accepted international e-commerce standards, including applicable U.S. consumer rules for cross-border sales.
By placing an order, the customer (hereinafter: “the Customer”) fully and unconditionally agrees to the contents and application of this Policy. The Dutch version is legally binding and governs in all cases; translations are for convenience only and have no independent legal effect.
Article 2 – Business Structure and International Shipping
Emma & Rose Manhattan operates under Dutch Chamber of Commerce registration OBS Zorg, legally established in the Netherlands. Emma & Rose Manhattan acts as a reseller and facilitates international deliveries through carefully selected production and logistics partners, mainly in China and the U.S.
All transactions are cross-border sales. The Customer acknowledges that deliveries may be subject to customs, import, or transport procedures beyond Emma & Rose Manhattan’s actual control.
Article 3 – Cancellation and Withdrawal
Products are generally made to order. Therefore, no statutory withdrawal right applies as defined under the EU Consumer Rights Directive or standard U.S. rules for customized products.
Cancellations or returns are granted solely at Emma & Rose Manhattan’s discretion and without acknowledging any legal obligation, provided all the following conditions are met:

The request is submitted in writing within 14 days of receipt to info@emmarose-manhattan.com;

The product is unused, undamaged, and in its original packaging;

Emma & Rose Manhattan has provided prior written approval (“Return Authorization”).
Returns without prior written approval will not be accepted or refunded.
Article 4 – Return Procedure, Costs, and Risk
All costs associated with returns, including shipping, customs, and clearance fees, are fully borne by the Customer, unless the return is directly due to an error by Emma & Rose Manhattan.
The risk of loss, damage, or delay remains with the Customer until Emma & Rose Manhattan has confirmed receipt in writing. Returns must be sent to the international address specified by Emma & Rose Manhattan, with the RMA number indicated. Shipments to incorrect addresses or without identification will not be processed.
Article 5 – Exclusions from Returns and Refunds
The following items are not eligible for return or refund:

Products made or personalized to the Customer’s specifications;

Hygiene items whose seals have been broken;
-
Items obtained through promotions, discounts, or “final sale” actions;

Products showing signs of use, stains, damage, or perfume/cleaning residues;
-
Orders containing multiple identical items in different sizes or colors clearly intended for fitting or comparison purposes.
Emma & Rose Manhattan reserves the right to refuse returns or apply reasonable depreciation in accordance with fairness and equity standards.
Article 6 – Defects and Warranty
Emma & Rose Manhattan ensures that delivered products materially correspond to the description on the website at the time of order.
Defects must be reported in writing within 14 days of delivery to info@emmarose-manhattan.com, including the order number and photographic evidence. After review, Emma & Rose Manhattan may, at its sole discretion:

Replace the product; or
-
Refund the purchase price.
Damage caused by incorrect use, negligent maintenance, or modification by third parties is excluded from any warranty. After the reporting period expires, all rights to repair or compensation lapse.
Article 7 – Refunds
Upon receipt and approved assessment of the return, the refund process will be initiated within 14 business days, using the same payment method as the original purchase.
Emma & Rose Manhattan reserves the right to apply a reasonable deduction to cover administrative, processing costs, or depreciation. Shipping, import, and customs fees will only be refunded if the return is directly due to an Emma & Rose Manhattan error.
Article 8 – Delivery and Transfer of Risk
Deliveries are made from international distribution centers, primarily in China and the U.S. Average delivery times range from 5 to 20 business days (international).
The risk of loss, damage, or delay passes to the Customer upon transfer to the carrier. Emma & Rose Manhattan is not liable for delays or additional costs caused by carriers, customs authorities, or other external entities.
Article 9 – Customs, Taxes, and Duties
Upon import into the U.S., Singapore, or other countries, customs duties, taxes, and/or additional charges may apply. Unless stated otherwise, these costs are fully borne by the Customer. Emma & Rose Manhattan has no influence over customs clearance procedures and accepts no liability for delays or additional costs caused by inspections or changes in legislation.
Article 10 – Liability and Limitations
Emma & Rose Manhattan is not liable for indirect or consequential damage, loss of profit, or intangible damage of any kind. Total liability is limited to the invoice amount of the relevant order. The Customer indemnifies Emma & Rose Manhattan against any claims by third parties arising from the use or misuse of delivered products.
Article 11 – Force Majeure
In cases of force majeure, including natural disasters, war, pandemics, government intervention, transport failures, or trade restrictions, Emma & Rose Manhattan has the right to temporarily suspend its obligations or terminate the agreement without liability.
Article 12 – Governing Law and Jurisdiction
This Policy is governed exclusively by Dutch law. Disputes are exclusively resolved by the competent court in ’s-Hertogenbosch, the Netherlands. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded. If any provision is invalid, the remaining provisions remain in full force.
Article 13 – Customer Service
Questions or requests must be submitted in writing to info@emmarose-manhattan.com. Emma & Rose Manhattan aims to respond substantively within 30 days.
Article 14 – Final Provision
By using Emma & Rose Manhattanservices and/or placing an order, the Customer acknowledges having read this Policy and agrees to the most recent version. The Dutch version is legally binding; translations are provided for convenience only.
Retour- en Terugbetalingsbeleid
Artikel 1 – Rechtsgrond en Toepassingsbereik
Dit Retour- en Terugbetalingsbeleid (hierna: “het Beleid”) bepaalt de voorwaarden waaronder aankopen via de officiële webshop Emma & Rose Manhattan kunnen worden geretourneerd, geannuleerd of vergoed. Het Beleid is opgesteld in overeenstemming met:

Het Nederlands Burgerlijk Wetboek;

De Consumer Protection (Fair Trading) Act 2019 (Singapore), voor zover van dwingend recht;
-
Algemeen aanvaarde internationale e-commerce-normen, inclusief Amerikaanse consumentenregels voor grensoverschrijdende verkoop.
Door het plaatsen van een bestelling verklaart de Klant volledig en onvoorwaardelijk akkoord te gaan met de inhoud en toepassing van dit Beleid. De Nederlandse versie is leidend; vertalingen hebben uitsluitend informatieve waarde.
Artikel 2 – Bedrijfsstructuur en Internationale Leveringen
Emma & Rose Manhattan opereert onder KvK-inschrijving OBS Zorg, statutair gevestigd in Nederland. Emma & Rose Manhattan fungeert als wederverkoper en faciliteert internationale leveringen via zorgvuldig geselecteerde productie- en logistieke partners, voornamelijk in China en de VS.
Alle transacties zijn grensoverschrijdende verkopen. De Klant erkent dat levering onderhevig kan zijn aan douane-, invoer- of transportprocedures buiten de feitelijke invloedssfeer van Emma & Rose Manhattan.
Artikel 3 – Herroeping en Annulering
Producten worden doorgaans op bestelling vervaardigd en verzonden. Er geldt geen herroepingsrecht zoals bedoeld in de Europese Consumentenrichtlijn of Amerikaanse standaardregels voor gepersonaliseerde producten.
Annulering of retour wordt uitsluitend toegestaan op basis van coulance, onder cumulatieve voorwaarden:

De aanvraag wordt binnen 14 dagen na ontvangst schriftelijk ingediend via info@emmarose-manhattan.com;
-
Het product is onbeschadigd, ongebruikt en in originele verpakking;
-
Emma & Rose Manhattan heeft vooraf schriftelijk goedkeuring verleend (“Return Authorization”).
Retouren zonder schriftelijke goedkeuring worden niet geaccepteerd of vergoed.
Artikel 4 – Retourprocedure, Kosten en Risico
Alle retourkosten, inclusief verzend-, douane- en inklaringskosten, zijn volledig voor rekening van de Klant, tenzij het retour het directe gevolg is van een fout van Emma & Rose Manhattan.
Het risico van verlies, beschadiging of vertraging blijft bij de Klant totdat Emma & Rose Manhattan ontvangst schriftelijk bevestigt. Retourzendingen moeten naar het door Emma & Rose Manhattan opgegeven internationale adres en met het RMA-nummer worden verzonden. Onjuiste of ongeïdentificeerde zendingen worden niet in behandeling genomen.
Artikel 5 – Uitsluitingen van Retour en Terugbetaling
De volgende artikelen komen niet in aanmerking:

Producten vervaardigd of gepersonaliseerd volgens specificatie van de Klant;

Hygiënische artikelen waarvan de verzegeling is verbroken;
-
Artikelen uit promoties, kortings- of “final sale”-acties;
-
Producten met gebruikssporen, vlekken, schade of parfum- of reinigingssporen;
-
Bestellingen met meerdere identieke artikelen in verschillende maten of kleuren, duidelijk bedoeld voor pas- of vergelijkingsdoeleinden.
Emma & Rose Manhattan behoudt zich het recht voor retouren te weigeren of een redelijke waardevermindering toe te passen.
Artikel 6 – Gebreken en Garantie
Emma & Rose Manhattan waarborgt dat producten materieel overeenkomen met de websiteomschrijving.
Gebreken dienen binnen 14 dagen na levering schriftelijk te worden gemeld via info@emmarose-manhattan.com, inclusief ordernummer en bewijsfoto’s. Na beoordeling kan Emma & Rose Manhattan:

Het product vervangen; of
-
Het aankoopbedrag terugbetalen.
Schade door verkeerd gebruik, nalatig onderhoud of wijziging door derden valt buiten garantie. Na verstrijken van de termijn vervallen rechten op herstel of vergoeding.
Artikel 7 – Terugbetalingen
Na goedkeuring van de retourzending wordt restitutie binnen 14 werkdagen verwerkt via dezelfde betaalmethode.
Emma & Rose Manhattan behoudt zich het recht voor redelijke inhoudingen toe te passen voor administratie-, verwerkingskosten of waardevermindering. Verzend-, invoer- en douanekosten worden alleen vergoed als de retour direct het gevolg is van een fout van Emma & Rose Manhattan.
Artikel 8 – Levering en Risico-overgang
Leveringen geschieden vanuit internationale distributiecentra, voornamelijk in China en de VS. Levertijden variëren gemiddeld tussen 5–20 werkdagen (internationaal).
Het risico van verlies, beschadiging of vertraging gaat over op de Klant bij overdracht aan de vervoerder. Emma & Rose Manhattan is niet aansprakelijk voor vertragingen of extra kosten door transporteurs, douane of externe instanties.
Artikel 9 – Douane, Belastingen en Heffingen
Bij invoer in de VS, Singapore of andere landen kunnen douanerechten, belastingen of heffingen verschuldigd zijn. Tenzij anders vermeld, zijn deze volledig voor rekening van de Klant. Emma & Rose Manhattan is niet aansprakelijk voor vertragingen of extra kosten door douane-inspecties of veranderende wetgeving.
Artikel 10 – Aansprakelijkheid en Beperkingen
Emma & Rose Manhattan is niet aansprakelijk voor indirecte of gevolgschade, winstderving of immateriële schade. Totale aansprakelijkheid is beperkt tot het factuurbedrag van de bestelling. De Klant vrijwaart Emma & Rose Manhattan van aanspraken van derden door gebruik of misbruik van de producten.
Artikel 11 – Overmacht
Bij overmacht (natuurrampen, oorlog, pandemieën, overheidsingrijpen, transportstoringen, handelsbeperkingen) kan Emma & Rose Manhattan verplichtingen tijdelijk opschorten of de overeenkomst beëindigen zonder schadeplicht.
Artikel 12 – Toepasselijk Recht en Bevoegde Rechter
Op dit Beleid is uitsluitend Nederlands recht van toepassing. Geschillen worden exclusief beslecht door de bevoegde rechter te ’s-Hertogenbosch, Nederland. Het Weens Koopverdrag (CISG) is uitgesloten. Indien een bepaling nietig is, blijven de overige bepalingen onverminderd van kracht.
Artikel 13 – Klantenservice
Vragen of verzoeken dienen schriftelijk naar info@emmarose-manhattan.com te worden gestuurd. Emma & Rose Manhattan streeft naar reactie binnen 30 dagen.
Artikel 14 – Slotclausule
Door gebruik van de diensten van Emma & Rose Manhattanen/of het plaatsen van een bestelling verklaart de Klant kennis te hebben genomen van dit Beleid en akkoord te gaan met de meest recente versie. De Nederlandse versie is leidend; vertalingen zijn uitsluitend informatief.
